BJ's Wholesale Club Pays 233 Employees $320,000 in Overtime Back Wages Following U.S. Labor Department Investigation

BOSTON -- BJ's Wholesale Club, Inc., based in Natick, Mass., has paid $320,000 in back wages to 233 employees for uncompensated overtime work revealed during a U.S. Department of Labor investigation.

"Both this investigation and our new Overtime Security rules reflect our commitment to protecting the overtime rights of workers," said Secretary of Labor Elaine L. Chao. "In this case, Club Personnel Managers weren't receiving their rightful overtime pay, and this Administration took action and restored $320,000 in back wages to 233 employees. Workers' overtime rights are further strengthened by our new Overtime Security rules, which increase protections for millions of workers by updating and clarifying the old regulations."

The investigation by the Labor Department's Wage and Hour Division covered the period between Oct. 6, 2001 and Oct. 4, 2003 and found that one position in the company - that of Club Personnel Manager - was improperly classified by the employer as being exempt from overtime under the federal Fair Labor Standards Act (FLSA).

Under the FLSA, covered workers are entitled to the minimum wage and overtime pay at one and one-half times the regular rate of pay after 40 hours of work in a workweek.

The company owns and operates a chain of retail "club" establishments with 140 locations throughout the Northeast. A self-audit done by BJ's subsequent to the Labor Department investigation revealed that the firm employed 233 individuals in the position of Club Personnel Manager during the period covered by the investigation. It was also shown that each of these employees worked approximately five hours of overtime per week during the period.

BJ's management agreed that the 233 Club Personnel Managers were due $320,000 in overtime-back wages, and to complete the back wage payments by June 30, 2004.

The Wage and Hour Division (WHD) recovered more than $212 million in back wages in fiscal year (FY) 2003, a 21 percent increase over the record-setting amount of FY 2002. Average days to resolve a complaint decreased in FY 2003 from 129 days to 108 days. WHD assessed employers nearly $10 million in civil money penalties in FY 2003.

  4. For the quite ignorant person who made the comment above me why don't you try being homeless? I have not heard one person say they don't like there job or they don't want to work there. It is a reality that employers are not going to pay you what you deserve to get paid. Why, because it's money out of their pockets. I don't feel like there is a problem in knowing that I deserve more and neither do they, but since you feel like YOUR good for nothing... good for you. This does not mean I don't enjoy my job or that I don't feel like there are good aspects of it, but the reality is there are a lot of things that could be better and pay is one of them.

  6. Never said I didn't think God for having a job, but I do know you should stop contradicting yourself. For some reason people in general have a problem with letting someone else have an opinion. People always chastise others because they don't have the same opinion as them. And that's your problem! If your homeless good for you there's plenty out there, but don't tell someone else what they should do. And I'm wondering if you ever been homeless in your life forced to live on the street cause you throw it around so loosely and like it's a bad thing. Just to let you know some people choose to be homeless. For a wake up call also, my little job at BJ's is not enough to keep a roof over my head. That's why you should not assume things about people.

  7. People should not complain about a job they apply for. If applying you should look into what goes on there before. Ex:what they do ?do they work long hours ? things like that. Now if your there for a while and things get bad just look around to better yourself see what,s out there.But sometime its not always more green on the other side.

    2. TRUE I was sick and called in one night. I didn't call in 2 hours before I did it 1 hours before my shift. the manager said i would be written up, but when i did the manager put me as a "no call no show" and they hit me with 2 correctives at once. Nice huh? I think my store has fired like 20-30 ppl in a 3 month period since they opened.

    3. I called out one day in Sept. 2012. Was really sick. On Jan 12, 2013, I was called into the GM 's office and told that I am fired. I asked why? The new fucking cunt told me that I called out in Sept. I said that I have sick hours. She said too bad. BJ's all women home office cunt league, has decided to fire most of the men of overnight full time workers and replace them with part timers. No benefits. Although, I am collecting a nice unemployment check each and every week.

When I told the 'chain of command', they told me not to worry. So, then I contacted the Regional whore monitor at the time, Regina 'I don't like white men' Campbell, she wouldn't listen to what me a couple of other people were reporting, she was trying to hang me for complaining. She wanted me to sign a paper stating that I was working too hard and I am stressed out. I told her no. She threatened me with being terminated. I contacted my lawyer. And thank the electronic companies with their electronic phone cameras with audio, I had that fucking bitch fired.

  10. I've been at BJ's for over a year now and I agree it is all about politics. RMs always use scare tactics to get the job done. Hourly employees are held more accountable than managers. They look for any reason they can find to write you up. Overnight Managers are working between 65-80 hours a week whereas day managers are working between 40-48. No wonder why everyone quits except senior managers. There's just way too many chiefs and not enough indians

  12. It's true that a lot of managers are getting away with things that any other employee get fired for. I've been with Bjs for over 8 years now, working my way up in positions. It's about hard work and perseverance and patience. But then again my manager could put in risk our customers with lamebrain ideals and policies. Climbing that ladder of hierarchy does not work. But in the end I believe those who are wrong get theirs in the end.

  14. There is a November 2009 lawsuit regarding BJ's Mid Level management receiving OT pay for hours worked over 40. The Mid Level management would have to have been in that position in 2007. The lawsuit and settlement will affect current and former Mid Level managers. Please read up on it.

  15. Here it is. Not in a nut shell but with first hand experience. This suit was brought on by overnight managers. These managers are responsible for the duties to be performed by the associates. With short staffing of associates the managers become responsible to complete the job. Day after day there are not enough hands to complete the jobs. Managers are then doing the jobs of the associates.

    This suit started 2 years ago. I have worked there for 8 years. Staff has been cut back every one of these years. Also bring to this that business has grown over these years. What was the solution? Like I said before, make managers do more associate work. Push came to shove and salaried managers are now performing the same duties as associates. Work that is not exempt from wage and hour laws.

    My prediction is that this settlement will change the way retail management plans for growth. Bottom line growth will begin to be in line with operating costs, not bottom line desires. End does not justify the means anymore. Run your company better, not just pressure to make the buck.

    At BJ's there is a lucrative bonus plan for upper store management. Meet these goals and you are on your way up with cash in your pocket. This suit puts a dent into that logic. Time to pay the people to what they are doing and for management to do a better job of managing.

    I speak from nearly 30 years of retail. Mostly in management. I had seen this thing coming and got out of management for the above reasons. I do my job as an associate and go home. You got my 40 hours. You want more? Pay me overtime or find someone else to do my job.

    This is the second lawsuit about overtime issues this decade for this company. Both now lost.

  19. I love my job at BJS and I gladly put in overtime without complaining so that I can help grow the business. Someone has to do it. Do I wish I could get overtime, Yes, but I don't and i care about my job so I do it. I'm a mid level manager and I work my tail off. I do everything I ask my associates to do if not more. So, Not ALL mids are lazy and dishonest. Not one mid level in my store gets away with anything. We are all held accountable.

  21. BJ's wholesale is full of it they promise one thing and say one thing but then when it comes down to it nothing that they said is done. They expect you to bust your butt working all types of hours and going out of your way for them yet they don't ever do anything for there employee's.
    Well after all is said they can expect another lawsuit coming there way cause they owe a whole lot of back wages and the NYS Dept of Labor has been notified......thanks BJ's I gave you all the time you needed to fix our problem and nothing was done so now it's not in my hands anymore.

  24. In order for Bj's to be a better company, they need to start with the home office. They are useless, and all they do is pretend they know their job. The problem is not the managers is beyond that, managers in this company are not managers. The company is too cheap to have enough coverage, so members of management end up doing their duties plus associate duties. Then when they have a member complaint they raise hell, and everyone is pointing fingers. General Managers are too scared to speak up, because in this company u just take orders. They only care about making money with the least amount of employees, and althoug they pretend they care about members they don't. If they did, they would be fully staff. The sad thing is that the good employees that they do have are the ones working their butts off, while the ones that should be fired they too afraid to do so. This is just a horrible company to work for. I could go on for hours with all the things I have seen go on in this company.

  25. All I see here is complaining about pay and knocking the managers. If you don't like the pay, then quit. If your not willing to work hard, have patience and understand that things don't just happen over night, then working at Bj's is not your place to be.

    Every business has these same issues. Managers not pulling their own, low pay wages, and employees who should have been fired years ago.

    Don't worry about anyone else but yourself. Work hard, be honest, care about what you do and shine everyday. This is the only way you will ever be successful in your job/career.

    I have worked at BJ's for less then a year and was just promoted to a manager. Why? Because I know that sometimes you have to start at the bottom and work your way to the top. We have to eat a little crap and swallow our pride. Let's face it, retail sucks. If you don't like it then leave. If you can handle the crazy hours, rude customers, and things not always going your way, then work hard and be the best at what you do.

    The bad apples will eventually weed their way out of the company. Hang in their and be strong. This economy is hard right now. Your lucky to work for a company that is stable and growing. BJ's has allot to offer if you just give it time.

    1. There's working hard, then there's being a sap. Trust me, I know. All my General Manager does is use everyone, wants you to work all these crazy hours (without asking mind you; he's TELLS you and I usually laugh and say "ok" then leave 5 minutes after he does) then complains about payroll.

      I'm a very patient person. But the managers at my current club are just so plain lazy. All I -ever- see them do is sit up in Personnel. I had to cover the receiving dock as Backdoor AP this morning and I didn't leave until uh...215 pm? I went in at 10pm the night before. I continuously paged for my GM (the only SR. manager on) to come and lock and arm the door but that would've meant he'd actually have to come onto the floor. God forbid. The only reason I was able to leave at 215 was because my assistant operations manager walked back there for something.

      And you know what I got told when I asked for a swipe? "Uh, payroll's an issue. Why are you still here?"

BJ's like other retailers needs to wake up and realize that sooner or later if they continue to treat employees the way they do and continue trying to run the clubs on less than a skeleton crew, membership and sales are going to suffer. They push associates and mid level managers well beyond reasonable expectations and burn people out then fire them for not meeting job expectations and then start all over again. It's a vicious cycle.They say they are employee oriented and want a fun place to work but the second someone tries to make it fun they get written up for not doing their work. Also there are training programs online to help you develop or enhance your skills but you never have the time to take advantage of them and in some cases you are never even told about them.I worked at a club with an overnight crew that was and probably still is so physically and mentally exhausted it's a miracle that no one has been killed or very seriously injured.I would like to work there again if upper management was completely overhauled and the club was properly staffed to get the job done.

I'm getting tired of the person I work with who is a fulltime employee same as me and she does nothing but badmouth people and spread lies about the people who work really hard when she does nothing but stand around and talk for a long period of time !she makes people think the other person isnt doing their job when its her thats doing the compaining shes even badmouthed the managers and they still think shes the greatest person just because she makes people believe her!I believed her lies in the beginning but now I know who she really is !She makes your job miserable !And makes me feel like I dont want to go to work but I need my job to support my family! her kids are older and she shouldnt get the hours i need !I have worked there longer they all favor her shes got secrets and she steals I hope she gets caught !And all the managers still like her !I wish they would open their eyes and see her for who she really is!But in the meantime im getting harrassed by this woman and shes telling everyone its me making up things about her so everyone will hate me!I wish these rumors would stop about me I dont go spreading rumors about anyone im there to do my job not to deal with her !But shes interfering with my work also Can someone please help me !!!!!!!!!!I need some advice

  31. It's time for the employees to stand up for something in Bjs since management is more of a fraternity on the senior level. Get this there is a manager named Sicone he has gotten a cashier pregnant at one store, threatened to physically assault a person for being in the military at another store, had a sexual harassment charge at a third store, had his life threatened at a store kicked out of one store by a GM and Bjs keeps moving him around. Sad part is most of this has been in the last year. Yet he gets full support when he threatens other employees jobs. I've only been with Bjs for 3 years but Club 60 is a mess at the senior level there is a clique that is running this high volume club in the ground and there's no where to turn because corporate is going to support senior management no matter what they do. I hope the sale of Bjs slashes old managers so the ideas can change. I'm a good employee never written up and always on time even made star of the month. I'm just tired of this nonsense

  34. at 60 one day I accidently workd extra 30 mins and it didnt give me anywhere near overtime so I say to the manager my punch was restricted she says oh you stayed 30 mins extra dont worry Ill punch you out and take that off. THATS 2X THEY STOLE MONEY FROM ME NOW!!!

They need to do a cleanout of managers at club 189 i used to work tthere and i could name 2 managers there who need to go beth is one she manipulates and lies to help her favorite employees and that sue lady who was a demo supervisor last time i knew she has pulls to get things illegally done in that place she had the personnel manager change peoples hours to get the hours she wanted and stood around and talked for an hour one time not doing her job and got paid for it but still had her job if they were gone from there i would gladly want my job back at bj s they were 2 people that shouldnt work there

We have almost 15 managers on a day and short regular staff then while trying to finish your regular job that you been hired for they pull you and want you to fill other positions no compensations at all! They get new managers and don't train them the right way on doing there jobs when asking the GM for help she has no clue on anything, Staff change duties and dont train then you mess up....and get written up for there own mistake.....

    1. Melbourne Fl BJs used to be a happy environment...Until our "beloved" G.M. was rail-roaded out along with 4 or 5 lower managers...who actually worked!!!,and got the job done every day. A nearby BJs G.M. came in to fill the void and created a dead zone!!! axing people left and right until everyone was to the point of paranoia? I'm glad I left when I did!! In the meantime he's riding on the previous G.M.'s coat tails that had improvements in the making and he's taking the credit...That "SUCKS"...

  41. I agreed with you up to this past year. i always loved my job. I gave 20 years to them and always worked to the best of my ability. I was employee of the year a few years back but have become quite ashamed of my company. My dad died in December and My father-in-law died March I received NOTHING from the club.My siblings kept asking "its bj's going to sent flowers. I was so mortified. Now I am dealing with a sick (terminal) relative and im getting no help or support from the Personnel at club level No one can explain to me how FMLA works and how to start the process.I will just need a day off here and there and will not abuse this law.I JUST what it in my files in case things get bad and i'm needed more often.I cant even get an up to date employee handbook. I also needed a back belt but got tired of asking and finally just bought one myself. When my father in law died i only took one day off because we were short people and not one manager thanked me for that. Since then I have opened my eyes and will not longer see things the way I thought they were. My store managers are horrible. People are being pushed too hard. They are doing cruel things to the employees and bj's better smarten up soon or there is going to be a massive lawsuit.

  42. What we need is a union..I've talked to employees from a number of clubs (in NJ anyway) and we all agree that the time for complaining is over. Organized labor has tried to come in before but every time management spreads lies about unions and scares everyone into voting against the union. We need to take the power back from management, from the regionals, from the regional HR's, and from home office. They need us..if we all walked out on a random Saturday and started to strike it would kill business for the day. One club wouldn't be so bad..but if everyone in every club who has ever felt wronged by this company walked out.. it would cause a massive loss in money for them and that would hurt them more. Myself and other employees have already begun to compile a list of every OSHA violation or labor law that's been broken.. and we're getting ready to take everything to the next level. If you or others in your clubs share this belief, that we deserve better treatment and the time for action is now, gather all the information you can. Start forming your groups that are willing to stand up to this beast of a company and 7/4/12 we all call the hotline to complain, call department of labor, make anonymous tips to OSHA. That's the day it starts, that's the day we fight back.

  44. It is great that this site was created to help give an outlet and a voice to those of us who have suffered while working or currently working for BJ's. But I can't stress enough how important it is to hold BJ's accountable for what they are doing. As long as we keep silent, BJ's will continue to discriminate, harass, retaliate and wrongfully terminate against its employees. I recently filed an EEOC complaint against BJ's and it has been accepted and sent to the Enforcement Unit. The only way to get BJ's to stop violating our Civil Rights is to take action and hold them accountable. Venting our frustrations is a productive way to relieve the stress and anger but if each of us comes forward we can make a difference. I have heard from employees across the country with the same issues but without filing your complaints BJ's will NEVER change. We are not alone in this...we are the majority not the minority! Go to your local EEOC office and file your complaint, start the process stand your ground. FYI a former HR secretary filed an EEOC complaint against the corporate office for a lot of the same reasons listed in this blog and guess what she won! In Miami a couple of years ago two hispanic employees filed EEOC complaints against BJS and won also. Use this blog to encourage each other to fight against what has happened and to make a real difference to get BJs to stop the only way that really makes an impact...get them in the wallet. THINK ABOUT IT. DO SOMETHING!!
